Many of the people who find Dinky.Life are navigating some of the hardest seasons of their lives. We take that seriously, including in how we handle your information and the personal stories you choose to share.

We collect only the information we reasonably need to operate Dinky.Life, provide what you request, communicate with you, and improve the website. We do not sell your personal information for money. We will not publicly share a personal story you send us privately without first obtaining your permission.

Marketing emails include a way to unsubscribe, and you are always free to use it.

Dinky.Life is operated by MyTalkingEye Network LLC, a Colorado limited liability company located in El Paso County, Colorado, United States.

Products and services sold directly through Dinky.Life are offered by MyTalkingEye Network LLC. Products or services purchased through third-party platforms may also be subject to that platform's terms and policies.

1. Acceptance of Terms

By using Dinky.Life or purchasing products or services directly through the website, you agree to these Legal Policies and any additional terms that apply to a particular product, service, or program. If you do not agree, please do not use the website.

You must be at least 18, or have appropriate parent or guardian involvement when required, to make purchases, create accounts, or enroll in paid programs.

Dinky.Life may include educational content and programs for teens, families, schools, colleges, and community organizations. Programs involving minors may be subject to additional permissions or agreements. Children under 13 should not submit personal information directly through the general website.

2. Products & Services

Dinky.Life may offer speaking engagements, educational programs, online courses, digital resources, memberships, books, signed books, and other products or services.

Products and services purchased directly through Dinky.Life are offered by MyTalkingEye Network LLC. Purchases through third-party retailers or platforms are also subject to their applicable terms and policies.

Diana “Dinky” Smith is an author, storyteller, speaker, and creator of educational content and practical frameworks. Unless stated otherwise, Dinky.Life content is educational, informational, and inspirational.

We may modify or discontinue offerings from time to time. If a material change affects something you have already purchased, we will make reasonable efforts to address any remaining access or delivery obligations.

3. Important Disclaimer — This Is Not Therapy or Medical Care

Nothing provided through Dinky.Life is therapy, counseling, medical care, psychiatric care, mental-health treatment, diagnosis, or crisis intervention.

Diana “Dinky” Smith shares lived experience, personal perspectives, educational information, practical frameworks, and resources related to grief, loss, adversity, resilience, and difficult life experiences. She is not acting through Dinky.Life as a licensed therapist, psychologist, psychiatrist, physician, social worker, crisis counselor, or other licensed health-care provider.

Using Dinky.Life, participating in a course or program, attending a presentation, or communicating with us does not create a therapist-client, doctor-patient, counselor-client, or other licensed health-care relationship.

Our content is not a substitute for individualized professional care, diagnosis, or treatment. Grief, trauma, loss, adversity, and recovery are individual experiences. What helps one person may not be appropriate or effective for another, and no particular outcome is guaranteed.

4. Intellectual Property

Unless otherwise stated, original content available through Dinky.Life — including books and excerpts, stories, fictional characters and worlds, courses, educational materials, frameworks, methodologies, assessments, worksheets, exercises, prompts, poems, articles, podcasts, videos, presentations, graphics, photographs, artwork, downloads, and other creative works — is owned by MyTalkingEye Network LLC, owned by Diana “Dinky” Smith and used with permission, or lawfully used with permission from another rights holder.

Copyrightable material is protected by applicable copyright law. Names, logos, and other brand identifiers may also be protected by applicable trademark and unfair-competition laws.

You may use Dinky.Life content for personal, noncommercial purposes unless different terms apply to a particular product or license. You may link to public pages and quote brief portions of publicly available written content with appropriate attribution where permitted by law.

Except as permitted by law or authorized by us, you may not reproduce, republish, distribute, sell, license, upload, commercially exploit, or create unauthorized derivative works from protected content. You may not use paid or non-public materials to create competing products or provide them to others for unauthorized use.

You may not knowingly use protected Dinky.Life content to train, fine-tune, develop, or supply datasets for generative artificial-intelligence or machine-learning systems without permission from the applicable rights holder, except where permitted by law.

5. Course & Membership Access

Unless different terms are provided at purchase, enrolling in a course gives you a limited, personal, non-exclusive, non-transferable license to use its materials for your own individual, noncommercial purposes. You do not acquire ownership of the course or its content.

You may not share login credentials; redistribute, resell, record, or reproduce protected course materials; substantially reproduce them in a competing product or program; present yourself as an authorized Dinky.Life instructor or facilitator; or bypass payment, security, or access controls.

Schools, colleges, organizations, businesses, facilitators, and groups wishing to use materials with multiple participants may need a separate license or written authorization.

If a course is advertised as including “lifetime access,” that means for as long as MyTalkingEye Network LLC continues to maintain and offer that course. It is not a guarantee of perpetual availability.

We may suspend or terminate access for material violations of these terms. Refunds, if any, will be determined under the applicable Refund Policy and applicable law.

6. Your Content, Messages & Personal Stories

You retain any ownership rights you have in content you submit to us. You give MyTalkingEye Network LLC permission to receive, review, store, and respond to it as reasonably necessary to communicate with you, provide requested services, maintain business records, protect the website, or comply with law.

We will not publicly share, publish, quote, or use a personal story you send privately in a book, presentation, article, podcast, marketing material, social-media post, email, or other public content without first obtaining your permission.

If you post in an area clearly identified as public, other visitors may see that content. This does not give us permission to use your personal story for unrelated promotional purposes without any additional permission that may be required.

You agree not to knowingly submit unlawful, threatening, harassing, defamatory, fraudulent, or infringing material. We may remove public content that violates these policies, applicable law, or the rights or safety of others.

7. Testimonials & Results

Testimonials, reviews, and endorsements reflect individual experiences and opinions and are used with permission where required.

They are not a promise, guarantee, or prediction that you will have the same experience or achieve the same result.

We do not guarantee any particular personal, emotional, educational, professional, financial, or other outcome from our offerings. Material relationships connected to endorsements will be disclosed when required by law.

8. Disclaimer of Warranties

To the fullest extent permitted by law, Dinky.Life and its content, resources, products, and digital services are provided on an “as is” and “as available” basis, except for express promises made for a particular product or service.

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free. While we make reasonable efforts to provide useful and accurate information, content may occasionally contain errors or become outdated.

To the fullest extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where they cannot legally be excluded.

Nothing here limits a warranty, remedy, or consumer right that cannot lawfully be limited.

9. Limitation of Liability

To the fullest extent permitted by law, MyTalkingEye Network LLC and its owners, members, officers, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from Dinky.Life or its products and services.

Where liability may lawfully be limited but not excluded, our total aggregate liability for a claim will not exceed the greater of the amount paid directly to MyTalkingEye Network LLC for the product or service giving rise to the claim during the preceding twelve months, or $100.

These limitations do not apply where liability cannot lawfully be excluded or limited, including where applicable law provides otherwise for fraud, willful misconduct, gross negligence, or other non-waivable liability.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless MyTalkingEye Network LLC and its owners, members, officers, employees, contractors, representatives, and affiliates from claims, losses, liabilities, and reasonable expenses arising directly from your unlawful or unauthorized use of Dinky.Life, material violation of these policies, infringement of another person's rights through content you submit, or intentional misconduct.

This does not require you to indemnify us for conduct for which we are legally responsible.

11. Third-Party Services & Links

Dinky.Life may use third-party providers for hosting, email, payments, courses, analytics, scheduling, forms, media, and other business services. These providers may process information as necessary to perform their services and may have their own terms and privacy policies.

Dinky.Life may also link to independent retailers, social-media services, podcast platforms, booksellers, and other resources. Their own terms and privacy practices apply when you use them, and we do not control their content, availability, security, products, or services.

If we use affiliate links, sponsored recommendations, paid partnerships, or other compensated relationships, we will disclose them where required by law.

12. Speaking Engagements

Speaking engagements are contracted through MyTalkingEye Network LLC under a separate written agreement.

Submitting an inquiry, requesting availability, discussing an event, or receiving a proposal or quote does not by itself reserve a date.

The speaking agreement determines when a booking becomes binding and may contain terms regarding fees, deposits, travel, cancellation, postponement, recording, media rights, and event requirements.

If a signed speaking agreement conflicts with these general Legal Policies, the signed agreement controls for that engagement.

13. Governing Law & Dispute Resolution

These Legal Policies are governed by Colorado law, except where applicable law requires otherwise.

Before initiating formal legal proceedings, you agree to contact MyTalkingEye Network LLC at [email protected] and make a good-faith effort to resolve the matter. We will do the same. The parties will allow up to 30 days for informal resolution unless immediate action is reasonably necessary or applicable law provides otherwise.

To the extent permitted by law, unresolved proceedings will be brought in a court of competent jurisdiction in El Paso County, Colorado, or the appropriate federal court serving El Paso County.

Nothing here prevents an eligible small-claims action or limits a right that cannot lawfully be restricted.

14. Accessibility

We are committed to making Dinky.Life and its digital content as accessible and usable as reasonably possible.

If you experience an accessibility barrier, email [email protected] and tell us what you are trying to access. We will make reasonable efforts to address the issue or provide an alternative accessible method when reasonably possible.

15. Digital Millennium Copyright Act (DMCA)

MyTalkingEye Network LLC responds to notices of alleged copyright infringement in accordance with the DMCA.

A DMCA notice should identify the copyrighted work and allegedly infringing material, provide enough information for us to locate the material and contact you, include the statements required by applicable law, and contain your physical or electronic signature.

We will respond to valid notices as required by law. If your material is removed because of a DMCA notice and you believe the removal resulted from mistake or misidentification, you may submit a counter-notification containing the information required by law.

16. General Terms & Changes

If one part of these Legal Policies is found unenforceable, the rest continues to apply. If we do not enforce a provision on one occasion, we do not give up the right to enforce it later.

Additional terms may apply to a particular purchase, program, license, or service. When a separate written agreement applies and conflicts with these general policies, that agreement controls for the matter it covers.

You may not transfer your rights or obligations under these policies without our permission. MyTalkingEye Network LLC may transfer its rights and obligations as part of a legitimate merger, acquisition, reorganization, sale, or transfer of the business.

Provisions that reasonably need to continue after your use of Dinky.Life ends will continue to apply.

We may update these Legal Policies from time to time. We will post the current version here and update the Last Updated date. When appropriate, we may provide additional notice of significant changes.

PART II — PRIVACY POLICY

MyTalkingEye Network LLC respects your privacy. This section explains what we collect, why we collect it, who may receive it, and the choices available to you.

1. Information We Collect & How We Use It

Depending on how you use Dinky.Life, you may give us your name, email, phone number, mailing or shipping address, account information, purchase information, speaking-inquiry details, messages, feedback, personal stories, or information entered into forms or course features.

Our website and technology providers may automatically collect information such as your IP address, browser, device and operating-system information, pages visited, website interactions, referral information, dates and times of visits, and information collected through cookies, pixels, analytics, and similar technologies.

If you use a course or membership, we may also receive account, login, enrollment, access, and course-progress information.

We use information to operate and secure Dinky.Life; fulfill purchases; deliver courses, books, programs, and other services; manage accounts; respond to questions and speaking inquiries; send transactional and permitted marketing communications; understand and improve website performance; prevent fraud or misuse; maintain appropriate business records; and comply with legal obligations.

We do not sell personal information for money. Some privacy laws may define certain analytics or advertising activities as “sharing,” “sale,” or “targeted advertising” even when no money changes hands. Where applicable law provides an opt-out right, we will honor it.

2. Payments & Service Providers

Payments made directly through Dinky.Life may be processed by third-party payment processors such as Stripe or another provider identified at checkout. MyTalkingEye Network LLC does not intentionally store complete payment-card numbers on Dinky.Life.

We may receive transaction information such as your name, contact information, purchase, payment amount, transaction status, and limited payment-method information.

We also use service providers to operate our business. Depending on the services enabled, these may include HighLevel/LeadConnector, payment processors, email and communication providers, Google and other analytics or advertising providers, hosting and security providers, shipping services, and professional advisors.

We may disclose information when reasonably necessary to comply with law, respond to valid legal process, investigate fraud or security concerns, protect rights or safety, or complete a legitimate merger, acquisition, restructuring, or sale of the business.

3. Cookies, Analytics & Advertising

Dinky.Life may use cookies, pixels, tags, local storage, analytics tools, and similar technologies to make the website function, maintain account sessions, remember preferences, understand website traffic, protect against misuse, measure advertising effectiveness, and support marketing.

This may include Google Analytics and advertising technologies enabled on Dinky.Life.

Where required by applicable law, we will request consent for non-essential cookies or provide appropriate controls for applicable cookie, advertising, or privacy preferences.

You may also manage many cookies through your browser settings, although disabling some cookies may affect website or course functionality.

4. Email, Personal Stories & Sensitive Information

If you subscribe to marketing communications, we may send newsletters and occasional information about books, courses, speaking engagements, events, resources, and other offerings. Marketing emails include a way to unsubscribe.

Unsubscribing from marketing does not prevent necessary transactional communications such as receipts, account notices, course access, or responses to something you requested.

Because Dinky.Life discusses grief, loss, trauma, adversity, mental wellness, and other personal experiences, you may voluntarily share sensitive information. Please submit only information you are comfortable providing electronically.

A personal story sent privately to us will not be publicly shared, quoted, published, or used as promotional content without permission.

Information submitted through Dinky.Life does not create a confidential health-care or therapeutic relationship.

5. Data Retention & Security

We keep personal information only as long as reasonably necessary to provide requested products or services, maintain appropriate business and transaction records, meet accounting or legal obligations, resolve disputes, prevent fraud or misuse, and enforce agreements.

When information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it.

We use reasonable administrative, technical, and organizational safeguards designed to protect information in our control. However, no website, transmission, or electronic storage system can be guaranteed completely secure.

If you have an account, please protect your login credentials and do not share them.

6. Your Privacy Rights

Depending on where you live and which laws apply, you may have rights to access, correct, delete, or receive a copy of certain personal information; withdraw consent; object to or restrict certain processing; or opt out of certain sales, sharing, targeted advertising, or profiling.

This includes applicable rights that may be available to residents of Colorado, California, other U.S. states, the European Economic Area, the United Kingdom, or other jurisdictions.

To make a privacy request, email [email protected]. We may need to verify your identity. We will respond as required by the law applicable to your request and will not unlawfully discriminate against you for exercising a privacy right.

Not every privacy law applies to every business or every person. Nothing here represents that MyTalkingEye Network LLC is subject to a particular privacy law when that law does not apply.

7. Children, International Processing & Third-Party Sites

Dinky.Life does not knowingly seek personal information directly from children under 13 through its general website features. Children under 13 should not submit personal information directly through Dinky.Life without appropriate involvement of a parent, legal guardian, school, or organization.

Programs involving minors may use separate agreements, permissions, or procedures.

MyTalkingEye Network LLC is based in the United States, and our service providers may process information in the United States or other countries. Where applicable law requires safeguards for international transfers, appropriate mechanisms will be used as required.

Dinky.Life may link to third-party websites and platforms. We do not control their privacy practices, and information you provide directly to them is governed by their policies.

We may update this Privacy Policy as Dinky.Life, our technology, or applicable requirements change. Updates will be posted here and reflected in the Last Updated date.

PART III — REFUND POLICY

We want you to feel comfortable purchasing from Dinky.Life. If something goes wrong, please contact us. We would much rather have a conversation than leave you frustrated.

Speaking Engagements

Speaking engagements are governed by the cancellation, rescheduling, payment, and refund terms in the signed speaking agreement.

If that agreement conflicts with this Refund Policy, the speaking agreement controls.

Online Courses & Digital Products

Courses purchased directly through Dinky.Life may be refunded within 14 days of purchase by contacting [email protected].

Refunds are not available after more than 50% of a course has been completed or after substantially all downloadable course materials have been accessed or downloaded.

If a technical problem prevents you from accessing something you purchased, contact us and we will make reasonable efforts to correct it.

Approved refunds are returned to the original payment method. Processing time may vary depending on the payment provider or financial institution.

Memberships

Monthly memberships may be cancelled at any time. Cancellation stops future renewals, and access continues through the end of the period already paid for.

Payments for a current membership period are generally non-refundable except where required by law or otherwise agreed by us.

Special membership packages may have additional terms disclosed at purchase.

Books, Physical Products & Custom Orders

Books purchased through Amazon or another third-party retailer are subject to that retailer's return and refund policies.

For signed books or other physical products purchased directly from Dinky.Life, contact us promptly if your order arrives damaged, defective, or incorrect so we can arrange an appropriate resolution.

Personalized or custom-inscribed books are generally final sale unless damaged, defective, or incorrect.

Bulk, custom, personalized, or event orders may have separate cancellation and refund terms provided when ordered.

Refund Abuse & Payment Disputes

We may decline refund requests when we reasonably determine that the policy is being abused, including repeated purchase-and-refund activity or unauthorized copying or use of protected digital materials.

If you believe a charge is incorrect, please contact us so we have an opportunity to investigate and resolve it.

Nothing here limits a refund, cancellation, chargeback, or consumer-protection right available under applicable law.

Requesting a Refund

For purchases made directly through Dinky.Life, email [email protected] with your name, the email address used for the purchase, the product or service involved, and enough information for us to locate the transaction.

We will review your request and respond as soon as reasonably possible.
